On June 12, 2024, U.S. Senators Bill Cassidy (R-LA), Cindy Hyde-Smith (R-MS), and 33 Republican colleagues introduced a Congressional Review Act (CRA) resolution to oppose a Biden administration rule related to Title IX. The rule in question redefines "sex" to include gender identity and alters due process protections for students in disciplinary actions.
“Title IX has been about making sure women have a fair shake relative to men. The new Biden rule radically overhauls Title IX, injecting a progressive gender ideology that removes longstanding protections for women and girls. This is the death of Title IX as we know it,” said Dr. Cassidy. “Proud to join this CRA to stand with all women and girls, and ensure they have every opportunity to succeed on the field and in the classroom.”
Senator Hyde-Smith echoed these sentiments, stating, “President Biden’s Title IX regulation stretches the law beyond reason, ignores basic biological facts, and infringes on the rights of parents and teachers. It is a backward rule that only hurts women and girls by stripping away opportunities and rights they have enjoyed for decades. We must save Title IX by stopping this radical rule.”
Cassidy has initiated an investigation into the impact of allowing biological males to compete against female athletes. He previously released a preliminary report featuring testimony from female athletes who reported mental stress from competing against biologically male athletes.
The Biden administration's new rule extends Title IX protections to include gender identity and sexual orientation, permitting biological males identifying as females to participate in women's sports. The final rule also addresses issues related to free speech on campus, teacher unions' protection, and due process for students accused of sexual harassment.
Noncompliance with these updated Title IX regulations could result in institutions losing federal funding.
