U.S. Senator Bill Cassidy and U.S. Representative Kevin Kiley have introduced a Congressional Review Act (CRA) resolution aimed at overturning the Department of Labor's final worker classification rule, which could impact the ability of 27 million Americans to work as independent contractors. The rule has been criticized for potentially restricting the flexibility and freedom of independent contractors.

Cassidy expressed concerns about the new rule, stating, "The Biden administration's priority should not be to do whatever makes it easier to forcibly and coercively unionize workers. It should be to increase individual freedom and opportunity." He emphasized that the new regulation could jeopardize the ability of millions of workers to maintain flexible work arrangements.

Representative Kiley echoed similar sentiments, criticizing the Biden administration's rule for potentially costing millions of independent professionals their livelihoods and restricting the freedom of many others to have flexible work arrangements. He emphasized the importance of supporting workers rather than regulating them excessively.

Chairwoman of the House Education and the Workforce Committee, Representative Virginia Foxx, also voiced her support for the CRA resolution, highlighting the need to encourage entrepreneurial opportunities and flexibility for independent contractors, entrepreneurs, and small businesses.

A bipartisan group of senators including John Barrasso, Marsha Blackburn, Mike Braun, and many others have joined Cassidy in cosponsoring the resolution. The resolution aims to nullify the Department of Labor's rule and protect the interests of independent contractors.

In response to the growing opposition to the new policy, Cassidy penned an op-ed in Fox News condemning the negative effects of the DOL rule on American workers. Several organizations, including the American Trucking Associations, the U.S. Chamber of Commerce, and others, have also expressed their opposition to the new regulation.
